DMCA Policy

Das Cafe Am Rande Der Welt ("the Cafe") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Cafe's website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Filing a DMCA Notice of Infringement

If you believe that material or content residing on or accessible through the Cafe's website infringes a copyright, please send a notice of copyright infringement containing the following information to our Designated Copyright Agent:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
  2. Identification of the copyrighted works or materials being infringed.
  3. Identification of the material that is claimed to be infringing including information regarding the location of the infringing materials that the copyright owner seeks to have removed, with sufficient detail so that Das Cafe Am Rande Der Welt is capable of finding and verifying its existence.
  4. Contact information about the notifier including address, telephone number, and, if available, email address.
  5. A statement that the notifier has a good faith belief that the material identified in (3) is not authorized by the copyright owner, its agent, or the law.
  6. A statement made under penalty of perjury that the information provided is accurate and the notifying party is authorized to make the complaint on behalf of the copyright owner.

Filing a DMCA Counter-Notification

If you have received a notification that your content has been removed due to a copyright infringement claim, you have the option to send a counter-notification if you believe the content was removed as a result of a mistake or misidentification of the material. To file a counter-notification, please provide our Designated Copyright Agent with the following information:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Das Cafe Am Rande Der Welt may be found, and that you will accept service of process from the person who provided notification under DMCA subsection (c)(1)(C) or an agent of such person.
